This Privacy Policy explains how personal data of visitors to the online store www.temperance.sk, customers, and other data subjects are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 18/2018 Coll. on Personal Data Protection.

2. What Personal Data We Process

Depending on the purpose of processing, we may process in particular:

·      delivery address,
·      telephone number,
·      e-mail address,
·      order information,
·      payment information,
·      IP address,
·      data obtained through cookies,
·      customer communications,
·      customer account information.

The Controller does not process special categories of personal data pursuant to Article 9 GDPR.

3. Purposes and Legal Bases for Processing

3.1 Order Processing

Purpose:

·      receiving and processing orders,
·      delivery of goods,
·      processing payments,
·      communication with customers.

Legal basis:

Article 6(1)(b) GDPR – performance of a contract.

3.2 Accounting and Tax Obligations

Purpose:

·      issuing accounting documents,
·      bookkeeping,
·      compliance with legal obligations.

Legal basis:

Article 6(1)(c) GDPR – compliance with a legal obligation.

3.3 Complaints Handling and Customer Support

Purpose:

·      handling complaints,
·      communication with customers,
·      protection of the Controller’s legal rights.

Legal basis:

Article 6(1)(b) and (f) GDPR.

3.4 Marketing Communications and Newsletter

If the customer gives consent or where permitted by applicable law, the Controller may send:

·      news and updates,
·      marketing offers,
·      product information,
·      promotional discounts.

Legal basis:

Article 6(1)(a) GDPR – consent.

Consent may be withdrawn at any time by clicking the unsubscribe link in an e-mail or by sending a request to temperance@temperance.sk.

3.5 Customer Account

When registering a customer account, we process the data necessary for its creation and administration.

Legal basis:

Article 6(1)(b) GDPR – performance of a contract.

3.6 Contact Form

Data provided through the contact form are processed solely for the purpose of responding to the user’s request.

Legal basis:

Article 6(1)(f) GDPR – the Controller’s legitimate interest.

4. Cookies

The online store uses cookies for the following purposes:

·      ensuring website functionality,
·      traffic analysis,
·      improving user experience,
·      marketing activities.

Strictly necessary cookies are processed without the user’s consent.

Analytical and marketing cookies are used only after consent has been granted through the cookie banner.

Users may modify or withdraw their consent at any time.

5. Recipients of Personal Data

Personal data may be disclosed to:

·      e-commerce platform providers (Creative Sites s.r.o.),
·      marketing and analytics service providers (Google Ireland Ltd., Meta Platforms Ireland Ltd.),
·      e-mail communication and newsletter service providers (Ecomail.cz, s.r.o.),
·      accounting and tax advisors (Kros s.r.o., Grosmanova Group s.r.o.),
·      payment service providers (Tatra banka, a.s.),
·      shipping and delivery service providers (DPD SK s.r.o.),
·      public authorities where required by law.

Recipients process personal data only to the extent necessary for the performance of their services.

6. Transfer of Data to Third Countries

When using services provided by Google, Meta, or other international service providers, personal data may be transferred outside the European Economic Area (EEA).

Such transfers are carried out solely in accordance with GDPR and based on appropriate safeguards for the protection of personal data.

7. Data Retention Period

We retain personal data as follows:

·      orders and accounting documents: 10 years,
·      complaints: for the duration of the complaint procedure and thereafter as required by law,
·      marketing consents: until consent is withdrawn,
·      customer accounts: until the account is deleted by the user,
·      contact form submissions: maximum 12 months.

After the retention period expires, personal data are securely deleted or anonymized.

8. Rights of Data Subjects

Data subjects have the right to:

·      access their personal data,
·      rectify inaccurate personal data,
·      erase personal data,
·      restrict processing,
·      data portability,
·      object to processing,
·      withdraw consent,
·      lodge a complaint with a supervisory authority.

8.1 Automated Decision-Making and Profiling

The Controller does not carry out automated individual decision-making or profiling pursuant to Article 22 GDPR that would produce legal effects concerning the data subject or similarly significantly affect them.
